1. Agreement to Terms

By accessing or using ScreenGuide ("the App," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ScreenGuide. Please read them carefully.

2. Eligibility

• You must be at least 18 years old to use ScreenGuide
• You must be a parent, legal guardian, or authorized caregiver of any children for whom you create profiles
• You represent that all information you provide is accurate and truthful
• You are responsible for maintaining the confidentiality of your account credentials

3. Description of Service

ScreenGuide is a content discovery platform that helps parents and guardians:

• Discover age-appropriate shows and movies for their families
• Filter content based on themes, values, and preferences
• Receive personalized recommendations powered by artificial intelligence
• Read and contribute reviews from other parents
• Access detailed content analysis including theme tags and spectrum codes

4. User Accounts

4.1 Account Creation

• You may create an account using Apple Sign In or email/password authentication
• You are responsible for all activity under your account
• You must notify us immediately of any unauthorized access
• One person may not maintain multiple accounts

4.2 Account Security

• Keep your login credentials secure and confidential
• Do not share your account with others
• Use a strong, unique password (if using email authentication)
• You are liable for any unauthorized use resulting from your failure to secure your account

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Provide false or misleading information
• Engage in abusive, fraudulent, or illegal activity
• Violate the rights of other users or third parties
• Attempt to circumvent security measures or access restrictions

You may delete your account at any time through the App settings. Upon deletion, your personal data will be removed as described in our Privacy Policy.

5. User Conduct

5.1 Acceptable Use

You agree to use ScreenGuide only for lawful purposes. You will not:

• Use the App to harm, harass, or discriminate against others
• Submit false, misleading, or defamatory reviews or ratings
• Impersonate others or misrepresent your identity
• Attempt to gain unauthorized access to the App or other users' accounts
• Introduce viruses, malware, or malicious code
• Scrape, crawl, or harvest data from the App without permission
• Use automated tools (bots, scripts) to access the App
• Reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's operation

5.2 User-Generated Content (Reviews and Ratings)

When you submit reviews, ratings, or other content, you agree that:

• Your content is your own original work and does not infringe on others' rights
• Your content is truthful and based on your genuine experience
• Your content does not contain offensive, abusive, or inappropriate language
• You grant ScreenGuide a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App
• We may remove content that violates these Terms or is otherwise objectionable

6. Children's Profiles

• You represent that you are the parent or legal guardian of any children for whom you create profiles
• You consent to our collection and use of children's information as described in our Privacy Policy
• Children's profiles are for content filtering purposes only; children should not use the App independently
• You are responsible for supervising your children's media consumption

7. Intellectual Property Rights

7.1 ScreenGuide Ownership

All content, features, and functionality of the App, including but not limited to:

• Software code, design, graphics, and user interface
• ScreenGuide logo, name, and branding
• AI-generated theme tags and spectrum codes
• Database structure and algorithms

...are owned by ScreenGuide and protected by copyright, trademark, and other intellectual property laws.

7.2 Third-Party Content

Show and movie metadata, posters, and descriptions are provided by The Movie Database (TMDB) and are subject to their terms and conditions. All rights to such content remain with their respective owners.

7.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimers and Limitations of Liability

8.1 "As Is" Service

ScreenGuide is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

• The accuracy, reliability, or completeness of content or ratings
• The availability, uptime, or performance of the App
• The suitability of recommended content for your family
• The prevention of harmful or inappropriate content from being shown

8.2 Content Responsibility Disclaimer

You acknowledge and agree that:

• ScreenGuide does not create, produce, or control the shows and movies it analyzes
• Content ratings are generated by AI and may contain errors
• We are not responsible for the content of shows, movies, or third-party streaming services
• You are solely responsible for deciding what your children watch
• We cannot guarantee that filtered content will be appropriate for your family's specific values

8.3 Limitation of Liability

To the maximum extent permitted by law:

• ScreenGuide and its developers, officers, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages
• Our total liability to you for any claims related to the App will not exceed the amount you paid us (if any) in the 12 months prior to the claim
• We are not liable for any harm, distress, or damage resulting from your or your children's exposure to content discovered through the App

8.4 Third-Party Services

The App integrates with third-party services (TMDB, streaming platforms, etc.). We are not responsible for:

• The availability, accuracy, or content of third-party services
• Changes to third-party APIs or data
• Third-party terms of service or privacy policies

9. Indemnification

You agree to indemnify, defend, and hold harmless ScreenGuide and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of others
• Content you submit to the App
• Your children's exposure to content discovered through the App

10. Dispute Resolution

10.1 Informal Resolution

Before filing a formal claim, you agree to contact us at support@screenguide.app to attempt to resolve any disputes informally.

10.2 Arbitration

Any disputes not resolved informally will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action lawsuit.

10.3 Governing Law

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date

Your continued use of ScreenGuide after changes become effective constitutes acceptance of the updated Terms.

12. Termination

These Terms remain in effect until terminated by either you or ScreenGuide.

• You may terminate: By deleting your account and ceasing use of the App
• We may terminate: Immediately, without notice, if you violate these Terms or for any other reason
• Effect of termination: Your right to use the App ends immediately. Sections that should survive termination (e.g., disclaimers, indemnification) will remain in effect.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScreenGuide regarding use of the App and supersede all prior agreements.
